• Acceptance of the Terms of Service Agreement (TOS).
  By creating a Mutual play account, whether on a mobile device, a mobile application, or a computer (collectively, the 'Service'), you agree to be bound by I these Terms of Use, (ii) our Privacy Policy, Cookie Policy, Arbitration Procedures (if applicable to you), Safety Tips, and Community Guidelines, all of which are incorporated by reference into this Agreement, and (iii) any additional terms disclosed and agreed to by you if you purchase additional features, products, or services (collectively, this "Agreement"). Please do not use the Service if you do not accept and agree to be bound by all of the terms of this Agreement.
• Eligibility
  To register an account on Mutual Play and utilize the service, you must be at least 18 years old. By creating an account and using the Service, you represent and warrant that: • you have the legal capacity to enter into a binding contract with Mutual Play; • you are not a person barred from using the Service under the laws of Nigeria or any other applicable jurisdiction and • you will comply with this Agreement and all applicable local, state, and federal laws.
• Your Account
  You are entirely responsible for all activities that occur under your login credentials that you used to sign up for Mutual Play, and you are solely responsible for preserving the confidentiality of those credentials. If you believe someone has accessed your account, please inform us right once.
• Service Modification and Termination
  You can cancel your account at any moment for any reason by going to "Settings" on the Service and following the instructions. If you utilize a third-party payment account, such as Apple's App Store or iTunes Store, as the case may be ("App Store"), or the Google Play Store, you must handle in-app purchases through that account to avoid unnecessary invoicing. Mutual Play reserves the right to suspend or delete your account at any moment if it believes you have violated this Agreement. You will not be entitled to a refund for any purchases made after such termination.
• Your Personal Safety and Interactions with Other MembersMutual Play aims to encourage a respectful member experience with features like the double opt-in, which allows members to contact only after they have both expressed interest in each other, but Mutual Play is not liable for any member's behavior on or off the Service. You agree to exercise caution in all contacts with other members, especially if you choose to correspond or meet in person outside of the Service. Additionally, prior to using the Service, you agree to read and follow Mutual Play's Safety Tips. You promise not to offer financial information (such as credit card or bank account numbers) to other members, nor will you wire or otherwise pay money to them.
• Rights you Grant Mutual Play.
  By creating an account, you gran Mutual Play royalty-free, worldwide right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute any information you authorize us to access from third parties, such as Facebook, as well as any information you post, upload, display, or otherwise make available (collectively, "post") on the Service or transmit to other members (collectively, "Content"). Mutual Play's license to your Content is non-exclusive, except that Tinder's license to derivative works developed via use of the Service is exclusive.
• The Rules of the Community
  By using the Service, you agree that you will not: • use the Service for any illegal or forbidden purpose as set forth in this Agreement. • use the Service in any way that is harmful or malicious • Attempt to harm Tinder Mutual Play by using the Service They break our Community Guidelines, which are updated on a regular basis. • Spam any members, beg money from them, or swindle them. • mimic someone or something, or post images of someone else without their permission.
• Mutual Play maintains the right to investigate and/or delete your account without a refund if you have broken this Agreement, misused the Service, or behaved in a way Mutual Play considers inappropriate or unlawful, including actions or communications that occur on or off the Service.
• Purchases
  If you buy an auto-recurring periodic subscription through an in-app purchase, your Payment Method will be charged until you cancel the subscription. Your subscription will automatically renew for an additional equal term after your initial subscription commitment period, and again after any subsequent subscription period, at the amount you agreed to when you subscribed.
  If you want to change or cancel your subscription, log in to your third-party account (or Mutual Play Settings, if applicable) and follow the steps to cancel or terminate your subscription, even if you've already deleted your account with us or the Mutual Play's program from your device. Mutual Play  will retain all funds charged to your Payment Method until you terminate or cancel your subscription on Mutual Play or the third party account, as applicable. Deleting your Mutual Play account or deleting the Mutual application from your device does not terminate or cancel your subscription; Mutual Play will retain all funds charged to your Payment Method until you terminate or cancel your subscription on Mutual play or the third party account, as applicable.
• Disclaimers.
  Mutual Play PROVIDES THE SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, MAKES NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT CONTAINED THEREIN), INCLUDING, WITHOUT LIMITATION.
• You are liable for indemnity.
  You agree to indemnify, defend, and hold Mutual Play, our affiliates, and their and our respective officers, directors, agents, and employees harmless from and against any and all complaints, demands, claims, damages, losses, costs, liabilities, and expenses, including attorney's fees, arising out of or relating in any way to your access to or use of the Service, your Content, or your breach of this Agreement, to the extent permitted by applicable law.
